1. Who we are
Pro Media Mogul (“PMM”, “we”, “us”) builds and hosts
websites, customer relationship management systems and email communication services for South African
businesses, schools and associations.
These terms apply to this website, and to any enquiry, subscription, registration or contact form we
operate — including forms that appear on websites we build and maintain for our clients. Where a form
appears on a client’s website, that client and PMM each receive the information you submit, and each is
responsible for how they use it. Section 4 explains this.
2. Information we collect
We collect only what you give us. Depending on the form, that is typically:
- your name;
- your email address;
- your telephone number;
- your organisation or school;
- the content of your message or enquiry, and any file you choose to attach.
When you submit a form we also automatically record the date and time, your IP address, your browser
identification, and the page the form was on. We keep these specifically so that we can demonstrate, if we
are ever asked, exactly when and how you gave permission for us to contact you.
We do not knowingly collect information from children. Where a form concerns a child — for example a
school admissions or registration enquiry — it must be completed by that child’s parent or legal
guardian, and by submitting it you confirm you are that parent or guardian.
3. Why we use it, and on what basis
We use your information to:
- respond to you. This is the reason you filled in the form, and we rely on that
request to act on it; - provide a service you asked for, such as a quotation, registration or subscription;
- send you occasional email about our services, our clients’ services, offers and
news — where you have ticked the consent box on the form, or where you are an existing customer
and the email concerns similar goods or services; - meet our legal obligations, including keeping records of consent.
Ticking the consent box on a form is your permission for the marketing email described above. It is
separate from your enquiry: you can withdraw it at any time and we will still deal with your
enquiry. See section 7.
4. Who we share it with
We share your information with:
- the business, school or association whose website you used. If you completed a form on
a client’s site, your enquiry goes to that client so they can answer you. They decide how they use
it after that, in line with their own privacy practices; - our service providers, who process information on our instructions only — our
email delivery platform, our hosting providers, and our CRM systems. They may not use your information
for their own purposes; - authorities or advisers, where the law requires it or where we need to establish,
exercise or defend a legal claim.
We do not sell your personal information. We do not rent or trade mailing lists.
Our email delivery and hosting infrastructure is located in South Africa. Where a service provider
processes information outside South Africa, we take reasonable steps to ensure it is subject to protection
comparable to that required by South African law.
5. How long we keep it
- Enquiries: for as long as needed to deal with your enquiry and for a reasonable period
afterwards, normally up to three years. - Mailing list membership: until you unsubscribe, or until you have not engaged with our
email for a sustained period, after which we remove you. - Consent records: for as long as we hold your information, plus a reasonable period
afterwards. We keep these to prove your permission was properly obtained. - Unsubscribe and suppression records: indefinitely, so that we do not email you again
by mistake.
6. How we protect it
We take reasonable and appropriate technical and organisational steps to protect your information against
loss, unauthorised access and misuse, including encrypted connections, access control, and regular backups.
No system is completely secure, and we cannot guarantee absolute security. If a breach occurs that is likely
to affect you, we will notify you and the Information Regulator as the law requires.
7. Your rights
Under the Protection of Personal Information Act, 2013 (POPIA) you may:
- ask what personal information we hold about you, and ask for a copy;
- ask us to correct or delete information that is inaccurate, irrelevant, excessive, out of date,
misleading or unlawfully obtained; - object to us processing your information;
- withdraw your consent to marketing at any time — use the unsubscribe link at the
foot of any email we send, or write to us at the address in section 11. There is no cost, and it takes
effect promptly; - complain to us, and to the Information Regulator.

8. Using this website
You agree not to use this website or any form on it to:
- submit false, misleading or fraudulent information, or impersonate another person;
- submit another person’s details without their permission;
- send unlawful, defamatory, threatening, obscene or infringing content;
- upload malware, or attempt to gain unauthorised access to, disrupt or overload our systems;
- harvest information from the site by automated means, or use it to send unsolicited communications.
We may refuse, suspend or remove any submission, and restrict access, where we reasonably believe these
terms have been breached.
9. Content and intellectual property
The content, design, layout, graphics and code of this website belong to PMM or our licensors and are
protected by copyright and other intellectual property laws. You may view and print pages for your own use.
You may not otherwise copy, reproduce, republish or adapt any part of the site without our written
permission.
Anything you send us through a form remains yours. By sending it, you give us permission to use it for the
purposes described in section 3, and you confirm you are entitled to send it.
10. Information, quotations and liability
We take care to keep this website accurate, but we provide it “as is”. Content is general
information, not professional advice, and should not be relied on as the only basis for a decision. Prices,
availability and specifications may change without notice, and a quotation is not binding until we confirm
it in writing.
Where the website links to a third party, we do not control that site and are not responsible for its
content, its practices, or its privacy handling.
To the fullest extent permitted by law, and subject to the paragraph below, neither PMM nor any of our
directors, employees, partners, suppliers or clients is liable for any indirect, incidental, special or
consequential loss, or for any loss of profit, revenue, data, goodwill or business opportunity, arising from
your use of this website or from any information submitted through it. Our total liability arising out of or
in connection with this website is limited to R5 000 (five thousand rand).
Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited,
including liability for death or personal injury caused by our negligence, for fraud, or under the Consumer
Protection Act, 2008 where it applies to you.

12. Changes to these terms
We may update these terms from time to time. The version and date at the top of this page tell you which
version applies. Where a change materially affects how we use your information, we will take reasonable steps
to tell you. Continuing to use the website after a change means you accept the updated terms.
13. Governing law
These terms are governed by the laws of the Republic of South Africa, and are subject to the
non-exclusive jurisdiction of the South African courts.
